I. NOTICE OF JURISDICTIONAL SEVERANCE & SOVEREIGN STANDING


Pursuant to Uniform Commercial Code § 1-103 and UCC § 1-308, all natural, commercial, and equitable rights are hereby reserved by the authorized trustees and agents of Braziel Enterprises.

This organization operates in a private capacity under:

  • UCC § 9-102 – Definitions related to secured parties and collateral
  • UCC § 9-203 – Attachment and enforceability of security interest
  • UCC § 9-502 – Contents of financing statement
  • 15 U.S. Code § 1 & 2 – Antitrust and restraint of trade protections
  • 28 U.S. Code § 1746 – Unsworn declarations under penalty of perjury
  • 18 U.S. Code § 241 & § 242 – Conspiracy against rights and deprivation of rights under color of law

All materials found on www.BrazielEnterprises.org, www.BrazielCreekFoundation.org  — including but not limited to text, code, systems, trademarks, contracts, graphics, and AI-generated works — are protected under:

  • Title 17 U.S. Code § 101 et seq. – Copyright law
  • Title 15 U.S. Code § 1125 – Trademark and unfair competition
  • 18 U.S. Code § 1831–1839 – Economic Espionage Act

Violation of these rights shall be met with:

  • Immediate Notice of Claim
  • Secured UCC-1 Financing Statement filing
  • Commercial lien enforcement
  • Public demand for liquidated damages in the amount of no less than $500,000 per act, per party, per violation

III. NON-CONSENT TO SURVEILLANCE, MONITORING, OR TRACKING

All digital and administrative engagements with BrazielEnterprises.org and its users are protected under:

  • 18 U.S. Code § 2511 – Interception of wire, oral, or electronic communications
  • 47 U.S. Code § 605 – Unauthorized publication or use of communications
  • 5 U.S. Code § 552a – Privacy Act of 1974
  • Electronic Communications Privacy Act (ECPA)
  • International Covenant on Civil and Political Rights (ICCPR), Article 17

This domain explicitly rejects all unauthorized surveillance, cookies, behavior tracking, data extraction, and remote session interference. All actions by government agencies, intelligence contractors, AI scrapers, or metadata harvesters lacking express written contract are considered acts of digital trespass and wire fraud.


IV. NOTICE OF NAME, LAND, AND MINERAL INTERESTS

The name BRAZIEL is lawfully held as a toponymic estate rooted in historical and territorial origin tied to Braziel Creek, federally listed under:

  • 16 U.S. Code § 1271 – Congressional declaration of policy on wild and scenic rivers
  • 16 U.S. Code § 1274(a) – Designation of components in the National Wild and Scenic Rivers System
  • 16 U.S. Code § 1277(b) – Restrictions on acquisition of lands
  • 16 U.S. Code § 1278(b) – Rights of Indigenous or historically affiliated peoples to land, water, and customs

It is also a variation of the country Brazil in its surname format, signifying ascent. Any unauthorized actions to digitize, tax, acquire, securitize, or tokenize these assets — including minerals such as brass, copper, zinc, or land deeded by name-right — shall be treated as unlawful conversion, land theft, and commercial trespass.

Remedies shall include UCC lien, common law forfeiture, and publication of commercial default.


V. FEE SCHEDULE FOR TRESPASS & UNAUTHORIZED ENGAGEMENT

All violators of this notice are automatically invoiced under the following commercial fee schedule, which forms part of this standing contract by default:

VI. TERMS OF COMMERCIAL ENGAGEMENT

All parties seeking to interact, contract, serve, or notify Braziel Enterprises must:

Submit a wet-ink signed agreement in advance

Include proof of indemnity and lawful standing

File a Notice of Settlement Intent minimum 7 calendar days in advance

Failure to do so constitutes an act of bad faith, unlawful contracting, and will invoke automatic commercial default.


VII. INTERNATIONAL RIGHTS AND INDIGENOUS PROTECTIONS

This notice also serves under:

  • United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP) – Articles 25–32
  • American Declaration on the Rights of Indigenous Peoples (ADRIP) – Articles VI, XX, and XXIX
  • Treaty of Peace and Friendship (1836–1837) and successor customary law

Braziel Creek Foundation asserts all ancestral, economic, cultural, and sovereign rights to operate free from unwanted interference, including jurisdictional or political reclassification. This includes the right to self-identification, resource governance, and territorial reclamation.
